These Terms & Conditions apply to orders placed through the Olive Delivery online shop.

Austria

Email: info@olivedelivery.at

Mandatory statutory consumer rights remain unaffected.

2. Products and Orders

The products displayed in our online shop constitute an invitation to place an order.

Before submitting an order, customers can review and correct their order details.

By submitting the order, the customer makes a binding offer to purchase the selected products.

After the order has been submitted, an order confirmation is sent by email.

We reserve the right not to accept an order if, for example, a product is unavailable, the information provided is incorrect or an obvious technical or pricing error has occurred.

3. Prices

The prices displayed in the online shop include the applicable VAT unless expressly stated otherwise.

The price displayed at the time of ordering applies to the respective order.

Additional shipping costs may apply for deliveries outside Vienna as described below.

4. Payment

No prepayment or online payment is required.

Orders are normally delivered or dispatched first. The customer subsequently receives the corresponding invoice or receipt.

Payment can then be made by bank transfer. The invoice number should be used as the payment reference.

For orders personally delivered by Olive Delivery, particularly within Vienna, payment in cash upon delivery is also possible.

Customers who prefer to pay in advance may use the bank details provided with the order information and should use the order number as the payment reference.

We do not process credit or debit card payments through this website.

5. Delivery and Shipping Costs

Orders are delivered to the delivery address provided by the customer.

We normally aim to dispatch or personally deliver orders within 3 working days. Unless expressly agreed otherwise, stated delivery times are estimates and not guaranteed delivery dates.

Personal delivery within Vienna is generally free of charge.

For deliveries outside Vienna, additional shipping costs may apply. These costs depend on factors such as destination, parcel weight and the number of parcels.

Where applicable, the customer will be informed by email about the shipping costs after the order has been received.

For the first order, Olive Delivery generally covers the shipping costs. For subsequent orders outside Vienna, the applicable shipping costs will be communicated to the customer.

The customer is responsible for providing a correct and complete delivery address.

6. Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.

7. Right of Withdrawal

Consumers generally have a statutory right to withdraw from a distance contract within 14 days, unless a statutory exception applies.

Detailed information on the right of withdrawal, applicable exceptions, deadlines and return procedure is available separately under Right of Withdrawal on our website.

The statutory model withdrawal form is also available separately.

The statutory right of withdrawal does not apply to business customers.

8. Warranty

The statutory warranty provisions apply.

If goods are defective, damaged or do not correspond to the order, customers are asked to contact us so that the matter can be resolved promptly.

This request does not restrict any statutory consumer rights.

9. Natural Products

Many of our products are natural agricultural products.

Natural variations in colour, shape, size, texture or appearance may occur and do not in themselves constitute a defect where the product otherwise corresponds to the agreed description and quality.

10. Liability

We are liable in accordance with applicable law for damage caused intentionally or by gross negligence, for personal injury and in all cases where liability cannot legally be excluded or restricted.

Mandatory consumer protection and product liability provisions remain unaffected.

To the extent permitted by law, we are not responsible for damage resulting from improper storage, handling or use of products after delivery.

11. Data Protection

Personal data is processed in accordance with applicable data protection law.

Further information is available in our separate Privacy Policy.

12. Contract Language

Contracts may be concluded in German or English.

13. Applicable Law

Austrian law applies.

For consumers habitually resident in another country, this choice of law does not deprive them of mandatory consumer protection rights applicable under the law of their country of residence.

For business customers, Vienna shall be the place of jurisdiction to the extent permitted by law.

14. Final Provisions

If an individual provision of these Terms & Conditions is invalid or unenforceable, this does not affect the validity of the remaining provisions to the extent permitted by law.

Mandatory statutory provisions apply where applicable.
